Terms & Conditions

1. Definitions

In these Terms and Conditions:

  • "Istana Living" refers to Istana Living Pte. Ltd., a company registered in Singapore.
  • "Client" or "User" refers to any individual who contacts, engages, or uses the services of Istana Living.
  • "Services" refers to the consultancy, leasing, and home administration offerings described on our website.
  • "Agreement" refers to these Terms and Conditions together with any service engagement letter provided to the Client.
  • "Website" refers to the online presence of Istana Living at istanalivi.live.

2. Acceptance of Terms

By contacting Istana Living, submitting an enquiry, or engaging any of our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our services or website. Our services are available to individuals aged 18 years and above who have the legal capacity to enter a binding agreement.

3. Service Description

Istana Living offers three consultancy services to residential renters and property owners in Singapore:

  • Illuminated Property Portfolio — a curated property shortlisting and presentation service at SGD 200 per engagement.
  • Secure Lease Establishment — documentation management and lease negotiation at SGD 730 per tenancy.
  • Luminary Home Administration — ongoing property management at SGD 1,440 per annum.

Services are available to clients based in Singapore and, subject to capability, to overseas clients engaging Istana Living for Singapore properties. Geographic restrictions may apply to specific service elements.

4. User Responsibilities

Clients agree to:

  • Provide accurate and complete information when making an enquiry or engaging a service
  • Notify Istana Living promptly of any changes to their circumstances that may affect service delivery
  • Treat Istana Living staff and third parties introduced through our services with respect
  • Not misuse any property access facilitated by Istana Living during viewings or administration visits
  • Honour payment obligations within the timeframes set out in their service engagement letter

Prohibited conduct includes providing false information to obtain services, using Istana Living's introductions to circumvent our fees, and any action that could damage Istana Living's professional relationships with landlords or partners.

5. Intellectual Property

All content on the Istana Living website, including property narratives, photography, and documentation templates, is the intellectual property of Istana Living or its licensors. Clients are granted a non-exclusive, non-transferable licence to use materials provided through our services solely for their personal residential purposes. Reproduction, redistribution, or commercial use of any Istana Living content without written permission is not permitted.

6. Payment Terms

Service fees are stated in Singapore Dollars (SGD) and are due as follows:

  • Portfolio service: Full payment prior to portfolio delivery
  • Lease Establishment: 50% on engagement confirmation, 50% on lease signing
  • Home Administration: Annual fee invoiced in advance, due within 14 days

Payment is accepted by bank transfer or such other methods as agreed in the service letter. Fees are non-refundable once service delivery has commenced, except where Istana Living is unable to perform the agreed service.

7. Service-Specific Terms

Portfolio Service: Shortlists reflect properties available at the time of preparation. Istana Living does not warrant that any listed property will remain available until viewed. A revised portfolio may be prepared at no additional charge if all listed properties become unavailable within 5 business days of delivery.

Lease Establishment: Istana Living acts as consultant, not legal counsel. Clients are encouraged to seek independent legal advice on complex tenancy matters. Istana Living is not party to any tenancy agreement and accepts no liability for disputes arising between landlord and tenant after signing.

Home Administration: Annual administration covers the scope described in the service engagement letter. Additional or emergency works outside this scope will be quoted separately before instruction.

8. Disclaimers

Istana Living provides consultancy services based on professional experience and market knowledge. We do not represent or warrant that any property recommended will meet all client expectations, or that lease terms negotiated will achieve all desired outcomes. Property markets are subject to change. Advice is given in good faith but without guarantee of specific results.

9. Limitation of Liability

To the fullest extent permitted by Singapore law, Istana Living's total liability to a Client in connection with any service engagement shall not exceed the fee paid for that specific engagement. Istana Living shall not be liable for indirect, consequential, or special damages, including loss of revenue, opportunity, or enjoyment. This limitation does not apply to liability arising from fraud or wilful misconduct.

10. Indemnification

Clients agree to indemnify Istana Living against any claims, losses, or costs arising from their breach of these Terms, their misuse of property access, or misrepresentations made during the engagement process.

11. Termination

Either party may terminate a service engagement by written notice. Where a client terminates after work has commenced, fees for completed service elements are payable. Istana Living may terminate an engagement immediately if a client acts in breach of these Terms or in a manner that creates legal or reputational risk for our practice.

12. Dispute Resolution

These Terms are governed by the laws of Singapore. In the event of a dispute, parties agree to first attempt resolution through direct discussion. If unresolved within 30 days, disputes may be referred to the Singapore Mediation Centre before any court proceedings are initiated. The courts of Singapore shall have non-exclusive jurisdiction over any remaining disputes.

13. General Provisions

These Terms constitute the entire agreement between Istana Living and the Client in respect of services, superseding prior representations. If any provision is found to be unenforceable, the remaining provisions continue in full effect. Failure to enforce any right under these Terms does not constitute a waiver. Assignment of rights or obligations by the Client without written consent of Istana Living is not permitted.

14. Changes to These Terms

Istana Living reserves the right to amend these Terms at any time. Changes are effective upon publication on our website. Continued use of our services after any update constitutes acceptance of the revised Terms. For active engagements, material changes will be communicated by email.
